The Assessment Task
You are an Employment Law Consultant who has been asked to provide a 2,000 word research report to a Local Employers Forum on ONE of the following topics:
They want to know how they can close the gender pay gap within their organisation. Many of their employers have very few women at the top of their company with most being employed at the lowest pay points.
As a minimum your report should include information about the legal definition of equal pay particularly work of equal value and the problems with women’s pay and progression in the workplace. You should consider what other employers are doing and how successful this is and what they can do, based on the research, to close the gap.
They want to understand the issues with dismissing someone, other than for reasons of redundancy. They have heard about the Range of Reasonable Responses but don’t know that that means for them and they want to know if the current interpretation is likely to change.
As a minimum your report you should include information about the legal definition of unfair dismissal and likelihood of a successful claim or defence with reasons for this. You should consider how the RORR operates and whether it works effectively and what changes might be made to it.
They want to understand the law on employment status. They have heard about the recent decision of the Supreme Court in the Uber case and want to know how this might affect their members who often employ people worker contracts but are now concerned that they might be deemed to be employees.
As a minimum your report should include information about the different categories under which work can be done and the importance of that distinction, information about how the courts decide which category a claimant falls into, the Taylor Review and what they can do to protect them from a claim. You should consider whether the current definition is effective and what changes might be made in the future.
