Objective Memo: Rule Explanation Assignment
Read the Wojcik article. Follow the second option described in the article for writing a Rule Explanation Paragraph.
Read the Rule Explanation Paragraph transcript. Start the paragraph with a sentence that explains possession. Then, cite the case from which you have pulled the explanation (Case #1).
In the next 3–4 sentences, state facts from the case that will help you explain the rule.
In the last 1-2 sentences, explain how the court applied that rule to the facts to arrive at its conclusion on this part of the rule. Make sure to incorporate citations after every sentence.
Length of assignment: 100-200 words
Your assignment is to read the four cases attached, draft one rule explanation paragraph for Case #1, and one rule explanation paragraph for Case #2. The Rule Explanation Paragraph for Case #1 should focus on the element of possession only. The Rule Explanation Paragraph for Case #2 should focus on the element of the exercise of physical control only. Remember, each rule explanation paragraph will only discuss one of the two elements and only contain information from one case (not from multiple cases).
The four cases that you will read are:
Case #1: K-B Corp. v. Gallagher, 237 S.E. 2d 183 (Va. 1977).
Case #2: Zurich American Ins. Co. v. Public Storage, 743 F.Supp. 2d 525 (E.D. VA 2010).
Case #3: Morris v. Hamilton, 302 S.E. 2d 51 (Va. 1983).
Case #4: Handelsgesellschaft v. Sheridan Transp. Co., 800 F.Supp. 1359 (E.D. VA 1992).
