Why is the standard of proof is far lower in a civil trial than in a criminal trial?
Mark is charged with criminal assault for sneezing on an elderly neighbor when Mark was displaying symptoms of C19. The alleged victim is suing in civil court to recover damages. The neighbor later develops C19 symptoms and is placed on a ventilator for a month before a long and slow recovery begins.
Mark is acquitted in criminal court. Is it possible that Mark will still be held liable in civil court?
