Topic 13 DQ 1 Question:

When can an addendum and an amendment be written to supplement the student’s IEP? Provide an example for each.

In addition, what stakeholders need to sign these documents? Why are addenda and amendments important for IEPs?

 An addendum is used to clarify and require agreement on items that were not a part of the original contract. An amendment changes something that was part of the original agreement. Parents and the IEP team must both agree on the proposed amendment before implementing the IEP changes. The parent  can propose an amendment to the child’s IEP by submitting a written request to the school or IEP team. It’s more likely that the IEP team will agree to the changes and amend the IEP if you thoroughly explain the reasons for the proposed amendment and how it would help the  child progress. For example, if the school’s speech therapist informs parents  that they might make better progress with three sessions per week instead of two, you should provide the specific details of this conversation in your written request. The parent has to sign and all parties who will be partaking in change.

An addendum and an amendment can be written to supplement the student’s IEP when there is a need for change of time, easy, placement, or services. An addendum is used to clarify and require agreement on items that were not a part of the original contract – while an amendment changes something that was part of the original agreement. This means that a formal meeting is not required but there are still needed signatures. “It is important that the IEP chairperson contact the parent/guardian, the partner district representative, the SSD representative and discuss the contents of the Addendum.  If everyone is in agreement regarding the content and agrees that an IEP meeting is not necessary, then the chairperson should complete the Addendum.” This can only be done if all parties agreed that an IEP is not needed. All Rules must be followed according to  IDEA.  Also, “The school can initiate the amendment by sending the proposed revision to the parents. If you are a parent and agree with the proposed amendment, remember that you must sign and consent to the proposed amendment within 15 days if you want it to go into effect; it will not go into effect automatically.”

The stakeholders that must sign the necessary documents are all parties that were a part of the initial IEP and everyone must receive a copy of any changes that were made. There can be an amendment if the students’ need has changed in a certain area has changed but an addendum is completed to require information that was not originally agreed upon in the initial IEP meeting, for example, extended time or modified assessments. Addendums and amendments are important for IEPs because it is important for students because their needs and goals are ever-changing so the plans should change and grow with them.

An IEP amendment may occur within the school year or school semester. The student may need a small adjustment to their IEP therefore, this can be done with a few members of the IEP team. Please note this small meeting does not take the place of the annual meeting which will include the full IEP team. This adjustment can be a concern from the Parent and a Clinician that the student needs a goal adjustment and the entire IEP team does not have to meet to make the adjustment and begin the services. For example, if a Parent realizes that their child needs to obtain a new service such as Speech and both (Parent and Therapist) agree with verified assessment for identified services this amendment can be included in the IEP. However, the IEP Team will be informed of the changes by the assigned IEP team member who will act as district representative.

An addendum is an explanation where all members of the IEP Team are in complete comprehension to items that were not in the original IEP. Therefore, once the additional information has been inserted into the IEP the Case Manager will distribute copies to the Parent and School.

The addendum and amendment are important for IEPs because, of changes that have to be addressed concerning the student’s recent abilities being identified or something that was left out of the IEP meeting. Things that can be omitted from the meeting such as; time, placement, services, and ESY information.
